1. Introduction and Acceptance of Terms
Welcome to InspectorDock (https://www.inspectordock.com). These Terms of Service (“Terms”, “Terms of Service”, “Agreement”) govern your access to and use of the InspectorDock software-as-a-service platform (the “Service”), operated by InspectorDock (“we”, “us”, “our”, “the Company”).
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for changes.
2. User Accounts and Registration
To access certain features of the Service, you may be required to create an account. When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party.
You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.
3. User-Generated Content
Our Service may allow you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material (“User Content”). You are responsible for the User Content that you post on or through the Service, including its legality, reliability, and appropriateness.
By posting User Content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform such User Content in connection with the Service and InspectorDock’s business operations.
We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is unlawful, offensive, threatening, libelous, defamatory, or otherwise objectionable.
4. Payment and Billing Terms
Certain aspects of the Service may be provided for a fee. You agree to pay all fees associated with your use of the Service in accordance with the pricing and payment terms presented to you at the time of purchase.
We use third-party payment processors to process payments made to us. In connection with the processing of such payments, we do not retain any financial information such as credit card numbers. Rather, all such information is provided directly to our third-party processors.
InspectorDock reserves the right to change its prices at any time. In the event of a price change, we will provide reasonable notice to you prior to the change taking effect.
5. Subscription and Recurring Billing
Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles are set on a monthly or annual basis, depending on the type of subscription plan you select.
At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or InspectorDock cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting us at info@inspectordock.com.
6. Refund Policy
Unless required by applicable law, paid Subscription fees are non-refundable. Certain refund requests for Subscriptions may be considered by InspectorDock on a case-by-case basis and granted at the sole discretion of InspectorDock.
If you are not satisfied with the Service, you may contact us at info@inspectordock.com within 14 days of your initial purchase to request a refund.
7. Intellectual Property Rights
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of InspectorDock and its licensors. The Service is protected by copyright, trademark, and other laws of United States and foreign countries.
You agree not to copy, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as incidentally necessary to access and use the Service for its intended purpose.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL INSPECTORDOCK, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
9. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us at info@inspectordock.com.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
10. Dispute Resolution
Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved within thirty (30) days, either party may submit the dispute to binding arbitration in accordance with the rules of the American Arbitration Association (or equivalent body).
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of United States, without regard to its conflict of law provisions.
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service.
12. Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
